Modern legislative approaches, related to overcoming corruption influences in the sphere of foreign investment and bank activity in Ukraine

Abstract

The importance and a clear need for considering this issue as a separate subject of study is that legislation is one of the main means of ensuring a normal life in any society and state. For this reason, it should be acknowledged that the content and principles of legislative activity should always serve as a basis for all, without exception, political forces that come to power as a result of elections for a certain period.

That is why knowledge of this process and compliance with the rules of legislative technology should become a priority in the activity of both the whole Parliament and individual MPs, as well as other subjects of the legislative initiative, the exclusive list of which is defined in the Constitution of Ukraine (Article 93).

To a full extent, this also applies to activities related to foreign investment in Ukraine, given its considerable dependence on corruption effects.

Corruption practices violate the basic constitutional principles of respect for citizens' rights and freedoms, discredit political and economic reforms, cause financial crises, huge stratification of income, block the flow of investment, violate the principle of inflow. As a result, most developing countries suffer from corruption, according to the World Bank.

At the same time, one of the conditions that contributes to the increase of corruption risks and the emergence of corruption offenses is the imperfection of both bills submitted to the Verkhovna Rada of Ukraine and those adopted by the Parliament in the future.

Goal setting. These circumstances led to the choice of the topic of this scientific article and determined its main task – to develop scientifically based proposals aimed at solving existing problems in the field of foreign investment and banking activities of Ukraine.
