Directions of internal organizational activity of law enforcement bodies and features of the application of discretionary powers during their implementation

Abstract

The article establishes, analyzes and summarizes the main directions of intra-organizational activity of law enforcement agencies. Organizational activities related to human resources (selection, training and placement of personnel, distribution of functional responsibilities, etc.) are defined in these directions; information and analytical work; work planning and management decision-making; activities related to the organization of internal departmental control; establishment of interaction between staff units; 6) financial and logistical support, etc.

 It is emphasized that, based on the legal essence of discretionary powers within the internal organizational activities of law enforcement agencies, the possibility to apply them in most situations belongs to the heads of structural divisions of various levels during the implementation of such a type of internal management as the organization of personnel work. A manager has a particularly wide  range of such powers in the process of bringing a subordinate employee to disciplinary responsibility.

 The article states that the main feature of the exercise of discretionary powers in the process of intra-organizational activity of law enforcement bodies is the implementation of the specified process without the participation and control of private (natural and legal) persons within the system of relevant bodies. Decisions of the subjects of power, which were made on the basis of discretion, are sometimes difficult to appeal even through the courts.

 This creates a favorable basis for the commission of corruption offenses, and the specified problem directly affects the efficiency and effectiveness of the law enforcement body as a whole, which is especially dangerous during the period of armed aggression by the russian federation. In order to minimize the specified risks during the implementation of discretionary powers by the heads of law enforcement agencies in the process of their intra-organizational activities, the urgent problem of introducing control mechanisms over the management process arises.
