Abstract

The article examines wage guarantees as one of the key elements ensuring the stability of labour relations under martial law. It is substantiated that guarantees constitute an essential component of the mechanism for the implementation of labour rights, as they ensure the transition from their formal proclamation to their actual realisation. Wage guarantees occupy a special place within the system of legal guarantees, as they are aimed at ensuring timely, full and fair remuneration for work, establishing minimum state standards, and preventing unjustified reductions or delays in wage payments. The article analyses scholarly approaches to understanding the essence of wage guarantees and reveals their significance as an element of the stability of labour relations under a special legal regime. It is established that under martial law wage guarantees have a comprehensive nature and include a set of legal, organisational and economic mechanisms aimed at preserving labour ties between employee and employer, maintaining the minimum level of employees' material security, and ensuring the continuity and predictability of labour relations. It is proved that wage guarantees serve as an important instrument for balancing the interests of the parties to an employment contract under conditions of increased risks and instability. Particular attention is paid to the analysis of the provisions of the Law of Ukraine "On the Organisation of Labour Relations under Martial Law".
