Tactical Aspects of Conducting Searches in Places of Worship

Abstract

This article examines the tactical aspects of conducting searches in religious buildings as a specific type of investigative (search) activity. The relevance of the topic stems from the current challenges facing criminal justice, which are linked to the need to ensure the effectiveness of pre-trial investigations while simultaneously upholding constitutional guarantees of freedom of religion, respect for the religious sentiments of believers, and the prevention of undue interference in the sphere of spiritual life. The special legal status of religious buildings, their sacred significance, and the specific nature of religious organizations’ operations necessitate the development of special tactical approaches to conducting searches. The purpose of this article is to examine the tactical features of conducting searches in religious buildings, taking into account their legal status and the specific nature of religious organizations’ operations. The methodological basis of the article consists of general scientific and specialized legal methods, in particular analysis, synthesis, the systemic approach, formal-legal, comparative-legal, and logical-legal methods, which allowed for a comprehensive examination of the legal nature of religious buildings and their place within the system of objects that may be subject to search. Scientific approaches to defining the concepts of “religious buildings,” “places of worship,” and “religious shrines” have been analyzed, and a lack of uniformity in their interpretation has been established. It has been established that the effectiveness of conducting a search in religious buildings largely depends on the investigator’s adequate level of preparation, which involves gathering complete information about the site, studying its layout, identifying possible access and exit routes, as well as analyzing the internal organization of the religious community. The study substantiates the advisability of employing tactical approaches such as ensuring the surprise element of the search, organizing simultaneous investigative (search) operations in multiple locations, limiting information leaks, and ensuring proper coordination of the investigative-operational team’s actions. Attention is paid to the need to adhere to ethical standards, avoid conflict situations, respect religious sentiments, and handle religious objects with care.
