Administrative and legal Aspect of Legal Support for Combating Offenses in the Environmental Protection in Ukraine Field

The article examines the administrative-legal aspect of legal support for combating violations in the field of environmental protection in Ukraine. It is substantiated that this aspect should be considered as an independent and systematically organized segment of public-legal regulation, within which substantive legal regulations, activities of authorized bodies, administrative procedures, means of control, termination, documentation and legal prosecution of environmentally illegal behavior are combined. It is established that its legal nature is formed through the interaction of government, management, law enforcement and human rights principles, and the content covers not only the application of sanctions, but also prevention, recording of violations, procedural registration of decisions, compensation for damage and restoration of violated environmental law and order. Special attention is paid to the system of legal means, administrative procedures and entities through which combating violations in the environmental protection sphere is implemented, in particular the role of environmental control bodies, law enforcement bodies, local government bodies and mechanisms of interagency interaction. It was found that the effectiveness of the current administrative and legal mechanism is significantly reduced due to regulatory fragmentation, incompleteness of individual legal structures, insufficient consistency of procedures, weak coordination between response entities, as well as the complexity of proving and documenting environmental damage, especially in conditions of martial law. On this basis, directions for improving the legal support for combating environmental offenses are substantiated.
