Analysis of the essence of the right of civil servants to work in Ukraine: theoretical and legal characteristics

Abstract

This scientific article provides an in-depth theoretical and legal analysis of the essence of the right to work for public servants in Ukraine. It was determined that the right to work is a basic right that forms the basis for the implementation of other labor rights in the field of public service. The normative-legal framework, which regulates the labor relations of civil servants, was considered, and the key aspects of its practical implementation were identified. The positions of domestic scientists regarding this or that aspect of the investigated issues are detailed, the advantages and disadvantages of each approach are analyzed. Special attention is paid to the specifics of the mental work of civil servants, whose high level of intellectual training and professional competence are important for the effective performance of official duties. It has been established that specialization and continuous professional development are necessary conditions for maintaining a high professional level and adapting to changes in the field of public administration. Attention is focused on the constitutional basis of the right to work of civil servants, which is defined as a mandatory need for consolidation at the highest legal level. It is noted that this right is not only a guarantee of social security, but also a foundation for ensuring the stable functioning of the state apparatus. The study showed that the legal regulation of labor relations of civil servants is of great importance for ensuring their rights and guarantees. Based on the analysis of legislative acts and practical experience, proposals for further improvements in this area, aimed at increasing the efficiency of public administration and meeting the needs of society, have been put forward.
