Abstract

The article analyzes the administrative and criminal legislation that regulates counteraction to the illicit circulation of narcotic drugs and psychotropic substances. The changes that have taken place in the Criminal Code of Ukraine concerning qualification of crimes in the sphere of circulation of narcotic drugs, psychotropic substances, their analogues or precursors and other crimes against public health are determined. Scattered administrative offenses that encroach upon the legal relations of the circulation of narcotic drugs and psychotropic substances.

Having analyzed the administrative legislation of Ukraine in the field of illegal circulation of narcotic drugs and psychotropic substances, we conclude that some of its norms require substantial processing. The timely adoption of laws and regulations has played a significant role in strengthening the fight against drug addiction.

The ways of improvement of the administrative legislation regulating counteraction to illicit circulation of narcotic drugs and psychotropic substances are highlighted. The necessity of adoption of the new Code of Ukraine on administrative offenses is determined, which will enable the prosecution to be brought to justice for less significant offenses in the sphere of illegal circulation of narcotic drugs and psychotropic substances.
