O. MALINOVSKY'S CONCEPT OF THE PENITENTIAL SYSTEM: SOCIOLOGICAL ASPECT

Abstract

The article deals with the main achievements of academician O. Malinovsky concerning the application of sociological methods in the field of penitentiary law. The proposed sociological approach to researches of the problems of legal socialization of the personality, the conditions and causes of crime and the identity of criminals, to the development of criminal policy and the principles of penitentiary law, etc., is presented. The peculiarities of the methodology developed by the academician of empirical sociological research in the field of penitentiary law and its proposals on the legal socialization of criminals as one of the main tasks of the penitentiary system are revealed.

Malinovsky substantiated the necessity of carrying out sociological research on the problems of legal socialization of the individual, the conditions and causes of crime and the identity of criminals, the criminal policy and the principles of penitentiary law, etc. He was one of the pioneers among domestic scientists to develop methodologies, techniques and organization of empirical sociological research among offenders and persons serving sentences.

Malinovsky, considering the person as the main object of sociological research, developed his own system of methods of empirical sociological research in the field of penitentiary law.

Malinovsky’s scientific heritage in the field of penitentiary law has, for several decades, outpaced his contemporary science and remains relevant to this day.
