Administrative and Legal Foundations of the Activities of the National Police of Ukraine During the Period of the Legal Regime of Martial Law

Abstract

The article carries out a comprehensive theoretical and legal study of the administrative and legal principles of the activities of the National Police of Ukraine as a subject of public administration during the period of the legal regime of martial law. It is substantiated that administrative and legal principles constitute a set of principles, norms and procedures that determine the legal status of the police, the limits of the exercise of authority and mechanisms for ensuring human rights and freedoms in the field of public security. The normative sources of legal regulation of police activity are analyzed, the principles of legality, rule of law, proportionality and service orientation of police activity are characterized. Special attention is paid to the administrative and jurisdictional activity of the police as a form of implementation of administrative and legal principles in the context of proceedings in cases of administrative offenses and the application of administrative coercion measures during the period of the legal regime of martial law. It is proven that the effectiveness of the National Police, including during the legal regime of martial law, directly depends on proper regulatory support, procedural guarantees of individual rights, and the consistency of public authority powers with constitutional standards of human rights. Proposals are formulated regarding areas for improving the administrative and legal regulation of police activities in the context of the transformation of public administration and during the period of the legal regime of martial law.
