Administrative and Legal Principles of Providing Assistive Devices for the Rehabilitation of Persons with Disabilities as a Result of War

Abstract

This scientific article explores the administrative and legal principles governing the provision of assistive devices for the rehabilitation of individuals who have acquired disabilities as a result of war. It analyzes legislative and regulatory acts concerning the social protection of war veterans and the rehabilitation of persons with disabilities. Additionally, it reviews scholarly research addressing the challenges of social protection for military personnel and the rehabilitation of individuals with war-related disabilities.

The article concludes that administrative and legal regulation requires the establishment of clear conditions and procedures within legislative and regulatory acts for recognizing former military servicemen as persons with disabilities due to war and for facilitating their access to assistive rehabilitation devices. It clarifies that the status of a person with a war-related disability is determined by local government units responsible for veteran affairs. The military medical commission determines a serviceman's unfitness for duty and provides recommendations for rehabilitation aids. Furthermore, an expert team may include assistive devices in an individual's rehabilitation program. The responsibility for supplying rehabilitation aids rests with the social protection departments of local state administrations.

The need to amend national legislation in the field of social protection and rehabilitation of persons with disabilities has been proven. In particular, it has been proposed to enshrine in the provisions on the Ministry of Health of Ukraine and the Ministry of Social Policy, Family and Unity of Ukraine the obligation to provide persons with disabilities with assistive devices for rehabilitation in order to bring subordinate legislation into line with the requirements of legislative acts. The expediency of transferring powers to provide rehabilitation aids to persons with disabilities resulting from war from local social protection authorities to local departments for veteran policy has also been justified.
