NATURAL PERSON ENTREPRENEUR AS A SUBJECT OF PRIVATE INTERNATIONAL LAW: SELECTED ISSUES

The article provides a comprehensive study of the legal status of a natural person entrepreneur as a subject of private international law in the context of the transformation of Ukrainian national legislation and the intensification of European integration processes. The specific features of the private international legal personality of a natural person entrepreneur are analysed, problematic aspects of determining the entrepreneur’s personal law in legal relations complicated by a foreign element are identified, and the issues of qualification of the entrepreneurial status of a natural person within different legal systems are examined. Particular attention is devoted to a comparative legal analysis of individual entrepreneurship models in the member states of the European Union. The principal differences between the Ukrainian model of a natural person entrepreneur and the corresponding European approaches to the regulation of individual entrepreneurship are identified. The article also examines the impact of the reform of Ukrainian commercial legislation on the legal status of a natural person entrepreneur. The necessity of improving Ukrainian legislation in the field of private international law is substantiated.
