FINANCIAL LEGAL RELATIONS IN THE SPHERE OF FUNCTIONING OF THE STATE EXTRA-BUDGETARY SOCIAL FUNDS: THE CONCEPT AND FEATURES

The article examines the legal relations in the sphere of functioning of state extra-budgetary social funds as a form of financial relations.
It was noted that state budget funds are the species concepts of public Fund of investments. The author adheres to the division of public extra-budgetary funds into two groups: public extra-budgetary funds, which are replenished by insurance premiums and have a pronounced social orientation; public extra-budgetary funds, which are replenished by other sources. In work it is noted that in the state social off-budget funds at the present stage of development of the society comprise the Pension Fund of Ukraine; social security Fund; the Fund of compulsory state social insurance of Ukraine against unemployment.
Analyzed the state social off-budget funds for organizational-legal and interdisciplinary perspectives (in economic and legal sense). Features of creation and functioning of these Funds allow you to refer them to publicly-legal instruments which will be settled through a specific legal institution as «public social insurance».
Defines General characteristics (there are about mobilization, allocation and use of public funds; the regulation; are strong-willed, imperious, financial, economic and legal nature; it is one of the forms of realization of public interests; conflict) and special features (special subjects, object, different vector directions, long-term in nature in direct relation to a specific insured person) financial and legal relationships in the sphere of functioning of the state social off-budget funds. Proposed the definition of these relations.
