EXECUTION OF PUNISHMENT IN THE FORM OF IMPRISONMENT UNDER THE CORRECTIONAL LABOR CODE OF THE USSR OF 1970: HISTORICAL AND LEGAL ANALYSIS

In the article the historical and legal analysis of the main principles of the correctional labor legislation of 1970 is made. The specification of the standard legal statuses of the Correctional Labor Code of the Ukrainian SSR concerning execution of punishment in the form of imprisonment is also made.
It is proved that the Correctional Labor Code of the Ukrainian SSR not only reflected, concretized and supplemented the relevant provisions of the all-union correctional labor legislation, but also resolved many correctional labor issues itself.
The conclusion is made about what in the modern criminal and executive law of Ukraine is displayed concerning the main ideas of execution of punishment in the form of imprisonment for the Correctional Labor Code of the Ukrainian SSR.
The analysis of the legal and normative basis for the regulation of the punishment process during the second period of the penal and labor legislation codification has a politicized nature, because those historical conditions did not contribute to the adoption of the universal values, the formation of the respect to the human rights observance and the possibility to improve such standards, which is the most important issue.
The historical and legal analysis of the normative and legal regulation of the process of execution of punishment during the period of 1970s – early 1980s gives the possibility to say that the adoption of the Correctional Labor Code of the Ukrainian SSR did not remove from the agenda all those problems of the legal regulation of the execution of punishment and serving sentences. So, the execution of some types of punishment remained unregulated until 1983.
