Legal Status of the Bureau of Economic Security in the System of Law Enforcement Agencies of Ukraine

Abstract

In the context of the European integration processes in Ukraine, the basic principles of functioning of the law enforcement system require considerable attention in order to ensure the prosperity of the State, to maintain the welfare of society, etc., which can be achieved, in particular, by ensuring transparency and proper control in the area of economic relations, in particular, against any illegal practices and criminal threats.

In the doctrine of administrative law, economic relations are generally considered to be trade, monetary, financial and other types of legal relations that arise and exist between economic entities of public and private law regarding the production, distribution, exchange and consumption of goods, services and ideas. Thus, we believe that one of the main tasks of law enforcement agencies is to ensure that they are properly protected from external and internal threats in order to effectively use the material and financial potential of each of the participants in such legal relations.

Therefore, if we talk specifically about the law enforcement system in the area of economic security, we can state that it is a certain type of legal interaction between public administration entities with law enforcement powers and other private law entities which arose as a result of an offense which encroaches primarily on the economic interests of the State, business entities and worsens the financial and investment climate, and which is accordingly aimed at restoring violated rights in this area and bringing to justice those responsible.

Thus, our study will focus on determining the prerequisites for establishing a separate state body with a special status and specific tasks as a promising stage in the direction of countering offenses encroaching on the functioning of the economic system of Ukraine, and also on studying the legal framework for the functioning of the Bureau of Economic Security of Ukraine in the area of achieving and ensuring economic security in Ukraine, which is a prerequisite for the development of a stable legal and democratic state.
