Legal principles of digitalization of the sphere of provision of administrative services in Ukraine and the place of administrative law norms among them

Abstract

The article examines the system of regulatory legal acts of various legal force that constitute the legal foundations of digitalization in the field of administrative services. It is substantiated that in the system of relevant regulatory legal foundations, a key place is given to the norms of administrative law. It was found that the legal principles of digitalization of the sphere of administrative services in Ukraine are most expedient to understand as a system of a set of interconnected regulatory legal acts of different legal force, the norms of which are aimed at regulating and streamlining social relations that arise in the process of carrying out the relevant activity.

It was found that the system of legal principles of digitalization of the sphere of administrative services consists of: 1) the Constitution of Ukraine - the Fundamental Law of the state, which defines the key legal aspects of the work of the legal system, higher authorities and other key principles on which the regulation of all social and legal relations, including in the sphere of digitalization, is based; 2) international legal acts - conventions and agreements that establish international standards in the sphere of digitalization; 3) the legislation of Ukraine - the highest legal documents after the Constitution, which regulate social and legal relations in the sphere of administrative services, as well as the digitalization of the process of their provision; 4) subordinate regulatory legal acts of state authorities, in particular, the Cabinet of Ministers of Ukraine, regulating the "mechanical" issues of digitalization, in particular, the work of electronic registers, the provision of certain electronic services, and so on.

It is generalized that in the system of legal principles of digitalization of the sphere of administrative services in Ukraine, a key place is given to the norms of administrative law, because it is with the help of the latter: 1) general regulation of the sphere of administrative services is carried out; 2) the legal status of entities responsible for the process of digitalization of the sphere of administrative services is determined; 3) the forms and methods of carrying out the relevant activities are revealed; 4) guarantees of protection of personal data of users of administrative services are established.
