THE MAIN ASPECTS OF THE ANALYSIS OF CRIMINAL-EXECUTIVE LEGISLATION IN THE SPHERE OF MANAGEMENT AUTHORITIES AND PENITENTIARY INSTITUTIONS

Abstract

The activity of the penitentiary institutions and determined by the laws of Ukraine and finds its elaboration in the sources criminal executive law. Criminal-Executive legislation includes a huge list of regulations that govern these relationships and are called at the appropriate level to carry out the management of the prison system. But in the long process of reforming some of them lost their relevance, since the activities of bodies that are in a State of liquidation.

However, before the end of this process of elimination, we have to refer to them. Therefore a special challenge for today is the structure and content of criminal-executive legislation, including the basic provisions, which are regulated according to these sources.

Issues of criminal-executive legislation are devoted to the many works of scholars and practitioners, because in the process of State development it undergoes permanent changes.

In Ukraine the establishment of management bodies in the prison system, they go under another jurisdiction, their elimination, as legitimizing their activities requires monitoring of the sources of legislation.

The article made an analysis of the legislation in the field of the management of the prison system. Investigated the essence of criminal-executive legislation, defined his job in market conditions. Substantiation of that particular problem is the structure and content of criminal-executive legislation, including the basic provisions, which are regulated according to these sources.

The aim of this work performs a comprehensive analysis of current Criminal-Executive legislation in the sphere of management authorities and penitentiary institutions, which will organize the sources of this legislation and to facilitate the settlement of Criminal-Executive relations.

Regulation of legal relations the prison system must be pursued to maximize the implementation of the recommendations of the European Committee for the prevention of torture or inhuman, or degrading treatment or punishment, the practice of the European Court of human rights against the Ukraine and other countries, the recommendations of the Committee of Ministers of the Council of Europe.

A promising area of research advocates monitoring the sources of legislation and the settlement of their systems for the purpose of proper supervision and control by the authorities and penitentiary institutions and ensuring criminal enforcement policy.
