THE CONCEPT AND CLASSIFICATION OF SUBJECTS OF LEGAL SUPPORT FOR THE STATUTORY ACTIVITIES OF A STATE-OWNED ENTERPRISE IN UKRAINE

Abstract

The article, based on an analysis of scholarly views, the provisions of current legislation, and law enforcement practice, substantiates that the system of subjects involved in the legal support of the statutory activities of a state-owned enterprise operates at both external and internal levels. In particular, it is noted that, at the external level, the primary scope of work is carried out by executive authorities, whereas subjects at the internal level are engaged in the direct implementation of such legal support. It is established that the subjects of legal support for the statutory activities of a state-owned enterprise in Ukraine are individual and/or collective persons who, in accordance with the provisions of current legislation, are vested with a certain range of subjective rights and obligations in the field of the legal support under study. It is argued that the first group of subjects involved in the legal support includes higher and central executive authorities. It is proved that the second group comprises subjects directly responsible for the implementation of legal support (heads of enterprises and their legal departments).
