Problems of legal regulation of social protection of persons with disabilities as participants in social security relations in the field of care

Abstract

The article explores the issues of legal regulation of social protection for people with disabilities, particularly in the context of ensuring their social rights through the system of social services and care. The increasing number of people with disabilities, as well as the aging population, present serious challenges for the state's social policy, which requires effective changes in legislation and the organization of social services. The legal framework does not always meet the real needs of this category of citizens, and existing social services often prove to be insufficiently developed or accessible, leading to material, organizational, and social barriers for people with disabilities.

The article provides a detailed examination of various forms of social services available to people with disabilities, including home care, institutional care, daytime care, and social adaptation. Special attention is paid to the legal provision of these services, as well as the process of obtaining social services, which includes submitting an application, assessing individual needs, signing a contract, and monitoring the fulfillment of services. Problems that may arise at different stages of service provision are discussed, such as insufficient informational accessibility for people with disabilities, long assessment processes, and the lack of clear mechanisms for monitoring and control.

The article also emphasizes the importance of integrating people with disabilities into society through the provision of services that ensure their social rehabilitation and adaptation to social and labor conditions. In particular, the system of social services includes rehabilitation programs, medical assistance, psychological support, help with daily living, as well as transportation services to ensure the mobility of people with disabilities.

Different types of care, including institutional care, home care, and daytime care, are also examined, which allow people with disabilities to maintain a certain level of independence and social activity. Special attention is paid to the legal provision of care for people with disabilities, as each type of service has its own specific conditions for provision and organizational aspects that require effective control and the guarantee of rights for service recipients.

The conclusion of the article focuses on the need to improve legal regulation and expand access to social services for people with disabilities, which will facilitate their active participation in social life and improve their quality of life.
