CRIMINAL RESPONSIBILITY FOR RETURN TO LAND RELATIONS IN THE LEGISLATION OF FOREIGN COUNTRIES

The features of criminal responsibility for encroachments on land relations in Ukraine are considered taking into account the experience of foreign countries in this sphere. The experience of the countries of the European Union, the USA and the post-Soviet countries regarding the criminal legal counteraction to such an offense is analyzed. The common and distinctive features in approach to the criminalization of encroachments on land relations in different countries are formulated, the main types of crimes in this sphere are identified and characterized, and ways of taking into account positive experience for the improvement of criminal-law norms concerning counteraction to offenses in the field of land relations are described and characterized.
It is concluded that in highly organized, democratic societies, with a perfect system of legislation and mechanisms of liability for crimes in the field of land relations, the legislator is responsible for the protection of land, property rights, fertility, purpose and all that is associated with it and such crimes are classified as crimes in the field of economic activity and management.
