ECONOMIC COURT AS A SUBJECT OF PREVENTION OF CRIME IN UKRAINE: HISTORICAL ASPECTS

The article is devoted to the actual issues of the history of the creation of economic courts and their influence on the prevention of crimes in Ukraine. It has been determined that the practice of preventing crimes in Ukraine shows that there are problems in this sphere both theoretical and practical. This conclusion follows from statistical data on the state, level and dynamics of crimes committed during 1991–2018 and which show that both quantitatively (up to 500 thousand crimes are committed annually in Ukraine on average) and qualitatively (almost 40% of crimes belong to the category of grave and especially grave ones (Part 4, 5, Article 12 of the Criminal Code of Ukraine) these indicators do not change significantly, and, consequently, the system of preventive activities of the abovementioned subjects is not efficient and does not fully meet the legislative goals of preventing crimes.
Thus, the author analyzed the periods of formation and development of commercial courts, state arbitration and other bodies that within their competence in different periods of Ukrainian history considered disputes between economic entities.
In addition, an analysis of the regulatory framework was carried out, on the basis of which judicial reforms were carried out at various times.
Based on the analysis of normative legal acts that became the basis for determining the functions of commercial courts, it was substantiated that the economic court should be classified as specialized crime prevention in our country.
