PERSONALITY OF A SENTENCED PERSON AND DEFORMATION OF THE PERSONAL CHARACTERISTICS IN CONDITIONS OF THE ISOLATION FROM THE SOCIETY

Abstract

The identity of the convict and its deformation in isolation from society. The issues of the impact of punishment on convicts who are in conditions of detention are covered. The problems associated with the definition and characterization of the personality of the perpetrator and the personality of the convict are discussed.

Identified and described by scientists general personality traits allow us to define the person who committed the crime. Thus, the general concept of personality is the social component of a person: the subject of sociocultural life, which has a set of qualities and traits not inherited genetically, but formed due to the socialization of a person in society, and self-revealing in the context of social relations, communication and objective activity. The identity of the perpetrator is a deviation from a certain generally accepted standard.

The position of I. N. Dan'shin is supported, where the identity of the offender is a combination of essential and stable social characteristics and socially determined biopsychological features of the individual, which, objectively realized in the commission of a particular crime or crimes, give his act a character of public danger danger, in connection with which it is held accountable under criminal law.

It is stated that in the legal literature of general meaning, between the concepts of “the identity of the criminal” and “the identity of the convict” a conditional equality sign is put. Indeed, after all, a similar sign can be put between the general characteristics of the personality of the criminal and another person (for example, age, mental characteristics, temperament properties, medical indicators, etc.). However, experts have identified certain differences between the offender and the person who observes the law, the rule of law and morality. Moreover, we know certain classifications of behavior of a person with disabilities and the typology of criminals. Thus, it can be argued that the concept of “the identity of the criminal” and “the identity of the convict” are close, but not identical.

It is stated that the identity of the convict is studied from the standpoint of criminal executive law, criminal executive pedagogy and criminal executive psychology.

The author analyzes the correlation between the imposed punishment and the personal changes of the convict. The committed crime and the punishment imposed for it, fundamentally change the legal and social status of the individual, his psychological and criminal-legal characteristics.

The article considers the positive and negative features of punishment, as well as the possibility of correcting the personality of the convicted person in the exercise of the educational function.

It indicates the changes taking place in individuals in conditions of isolation from society, especially for a considerable period of imprisonment. Recommendations are given on taking into account the criminal and criminal-executive characteristics in the implementation of punitive-correctional impact on convicts, depending on the type of crime and term of punishment.
