A. Kripak, DEPRIVATION OF LIBERTY IN THE LEGISLATION OF UKRAINE AND SOME WESTERN EUROPIAN COUNTRIES

The article focuses on the deprivation of liberty, which is the most common type of the criminal punishment. The institute of punishment in general, its purpose, as well as the history of the offender’s imprisonment and its social functions on the territory of Ukraine are described. The general provisions of deprivation of liberty (both for certain terms and the life imprisonment) in the legislation of Ukraine and some countries of the Western Europe (Italy, Germany and France) are considered. Particular attention is paid to such type of punishment as the deprivation of liberty for certain terms. The issues related to the terms of imprisonment and the corre-sponding offenses, which envisage the imprisonment, the historical formation of imprisonment in the system of criminal penalties of Ukraine and some countries of the Western Europe as well as the purposes of such punishment, are considered. The types and forms of deprivation of liberty, which are envisaged in the Italian, German and French legislations, are described in.
