Abstract

The article provides a comprehensive analysis of the legally significant features of environmental management as a structural element in the development of Ukraine’s “green” economy. The study examines the normative foundations of environmental entrepreneurship, covering energy, transport, and waste management policies, and analyses their correlation with European approaches to environmental safety. It is demonstrated that the current legal framework remains fragmented and requires systematic modernization in light of contemporary ecological challenges, including the consequences of war and the obligations arising from the implementation of EU directives.

The article identifies three key dimensions of environmental entrepreneurship: as an object of legal regulation, which includes environmental standards, restrictions, and control procedures; as an instrument for implementing state environmental policy through market, incentive, and administrative mechanisms; and as an economic actor requiring a special legal regime due to the specific nature of environmentally oriented activities.

Criteria for assessing ecological impact are formulated, including emission reduction, resource efficiency, the introduction of environmentally friendly technologies, and the restoration of natural resources. Significant attention is paid to the classification of environmental management actors based on types of activity, the nature of environmental impact, commercial or non-commercial orientation, and territorial specifics, particularly in the context of post-war recovery.

The article further analyses the influence of external and internal factors on the development of legal mechanisms for economic greening, including the role of international obligations, the level of innovation potential, and public environmental awareness. It is substantiated that the effectiveness of the “green” transformation depends on the state’s ability to ensure a balanced regulatory environment and effective incentives for business.
