Peculiarities of labor relations of employees of the State Bureau of Investigation

Abstract

The peculiarities of labor relations of employees of the State Bureau of Investigation are considered. The points of view of scientists on the list of signs of labor relations are studied. The peculiarities of labor relations of employees of law enforcement agencies are studied.

It is proved that the labor relations of employees of the State Bureau of Investigation are characterized by most of the general features of labor relations, namely: 1) continuous nature, the legal relationship is not interrupted after the end of each working day, on weekends, holidays and non-working days, etc.; 2) personal nature, the employee personally performs the work, in accordance with his position; 3) paid nature, an employee of the State Bureau of Investigation receives remuneration for the performance of official duties; 4) complex nature, the parties to the legal relationship have a complex of mutual rights and obligations; 5) legal relationships arise as a result of concluding an employment agreement or contract; 6) the employee is included in the labor collective of the body or unit of the State Bureau of Investigation; 7) job duties are performed by employees of the State Bureau of Investigation under the established legal regime (internal labor regulations); 8) employees in the process of joint activities are subordinate to the head of the body or unit of the State Bureau of Investigation.

The features of labor relations of employees of the State Bureau of Investigation are determined, namely: 1) the prevailing imperative nature of establishing service conditions; 2) the presence of specific restrictions and prohibitions related to service (prohibition of membership in political parties, etc.); 3) enhanced legal and social protection of the employee; 4) the specific order of dynamics of labor relations; 5) the content of the employee's labor function - the performance of the law enforcement function of the state.
