WAYS OF ADAPTATION OF UKRAINE'S CRIMINAL PROCESSAL LEGISLATION TO INTERNATIONAL STANDARDS

Abstract

The article is devoted to the problems and improvement of domestic criminal procedural legislation taking into account decisions of the European Court of Hu- man Rights. It is noted that the most violated are the following principles of the criminal process, such as: equality of parties, rule of law, binding judgments, independent and impartial trial. The current trends of criminal justice and compara- tive characteristics of the case law of the European Court of Human Rights are considered. The problems that arise when applying the European Court of Human Rights practice are analyzed, the question is whether all decisions are the source of law or only those in which the defendant is Ukraine. Examples of the European Court of Human Rights judgment in criminal justice are given. It is emphasized that the practice of the European Court of Human Rights is an official form of in- terpretation of the fundamental rights of every person, that is, it is the source of legislative legal regulation and enforcement in Ukraine. It is noted that according to the statistical data against Ukraine, the European Court of Human Rights is co n- sidering the largest number of proceedings in comparison with other countries. The ways of adaptation of the Ukrainian criminal procedural legislation to inter- national standards are investigated.
