CRIMINOLOGICAL ANALYSIS OF THE RESORTIALIZATION PROCESSES OF CONVICTS TO THE LONG TERM OF IMPRISONMENT IN UKRAINE

Abstract

The article analyzes, from the criminological point of view, characteristics of the tendency of committing crimes sentenced to imprisonment for the last 10 years. Author gives the criminological characteristic to the term «resocialization». The author proposes amendments to the legislative definition of the term «resocialization». In the article are proposed an author's classification of measures that constitute the level of individual prevention of crimes among convicts to imprisonment.

In the article mentioned that means of correction and resocialization of convicts are applied taking into account the type of punishment, the personality of the convicted person, the nature, degree of social danger and motives of the criminal offense committed and the behavior of the convicted person while serving the sentence.

Resocialization is applied the set of such measures:

process of logical justification, clarification of the necessity of adhering to the condemned standards of life in the society (individual conversations, collective discussions in small groups, listening of lectures on legal topics, with their further discussion, etc.);

conditions for the development of the person of the former guardian (in particular, obtaining at least the minimum necessary level of education for further effective employment, stimulating participation in public and cultural life);

organization of measures to ensure the positive direction of life of the perpetrators and punishment (organization of meetings with former prisoners who, with their example of successful resocialization, can create a proper motivation for the target audience);

social protection of former prisoners (employment assistance, improvement of living conditions, provision of free medical aid, establishment of useful links with public charitable organizations, etc.).
