PERSONAL SAFETY AS ONE OF THE MAIN CONSTITUENTS OF SAFETY AT THE PENAL ESTABLISHMENTS

Abstract

The analysis of the state of researches and definitions of the notion "personal security" at the penal establishments has been carried out in the article on the basis of the criminal-executive legislation of Ukraine and scientific sources.

The humanization of the relevant legislation has been one of the priority activities while reforming the Criminal Executive-Service of Ukraine. We have considered the normative regulation and scientific-theoretical elaboration of the of social relations issues, which arise in connection with the need to ensure security and personal safety at the penal establishments. Different directions of personal safety regulation in the criminal-executive legislation are considered. The state of researches and definitions of the notion «person safety» at the penal establishments is deeply analyzed on the basis of the content analysis of the criminal-executive legislation of Ukraine and the corresponding scientific sources.

The internal security of the criminal-executive service envisages the protection against dangers and threats, which arise directly at the bodies, institutions and establishment, which are involved in the sentences enforcement. The process of ensuring the internal security is regulated mainly by the criminal and criminal-executive legislation.

We can say that the personal safety at the penal establishments can be understood as well defined and guaranteed at the regulatory level, as well as insured by the law enforcement activities of the penal establishments’ officials and other persons, involved in protection against the external and internal threats concerning the rights and legal interests.
