METHODOLOGICAL INSTRUMENTS FOR STUDYING VIOLENCE IN CORRECTIONAL COLONIES OF UKRAINE

Abstract

The article deals with the question of methodological instruments for studying violence in correctional colonies of Ukraine. The opinions of domestic and foreign scholars on the application of methodological instruments in the research are analyzed. It is proved that the methodology of studying violence in correctional colonies of Ukraine is a system of scientific knowledge through the application of general scientific and special-scientific methods, which can provide the completeness of the objective analysis of the studied subject.

It has been determined that violence in penitentiary institutions is a socio-legal phenomenon characterized by a dynamic process and is constantly diversifying, extending to both convicted and penitentiary personnel.

In addition, convicting violent crimes by convicts in penitentiary institutions is not only a dangerous encroachment on the goals and objectives of justice, the normal work of penitentiary institutions of the Ministry of Justice of Ukraine, but represents a real threat to the life and health of both convicted and personnel of correctional colonies.

Conducting the comprehensive and systematic study of violence in penitentiary institutions, as well as constructive implementation of such tasks as: analysis of the state of scientific research for prevention of violence in these institutions; studying the concept and content of violence in penitentiary institutions, as well as studying foreign experience in this field; providing the criminal-legal characteristics of violence, depending on the generic object; study of criminological characteristics of violence in penitentiary institutions; the formulation of the concept and the development of a set of measures (general social, special-criminological, individual-preventive) for prevention of violence in penitentiary institutions, required the formation of a integral methodology of such study.

While conducting study of violence in penitentiary institutions, we have found that the trends of violence, in particular, are related to the isolation of convicts and the conditions of penitentiary personnel work, and therefore they do not always coincide with the dynamics of all criminality, which is typical for correctional colonies of the Ministry of Justice of Ukraine.
