TERRORISM IN UKRAINE: PROBLEMS OF SENTENCING, ITS EXECUTION AND SERVING

Abstract

The article analyzes the current state of terrorist threats arising in a globalized society. The essence and nature of terrorism is revealed. A brief analysis of publications devoted to the problems of countering terrorist activities is provided.

Based on the study of the practice of sentencing for the commission of terrorist acts, the creation of terrorist organizations or other, not provided for by law, militias and armed groups, financing of terrorism, riots, group violations of public order, etc., the main problematic issues related to sentencing.

It is indicated that terrorism in places of deprivation of liberty constitutes a serious threat to society. In many cases, it is similar in its structure, goals, objectives, forms of manifestation with the terrorist organizations of the world. Moreover, in isolation, there are unique opportunities for physical and mental impact on convicts with the goal of persuading them to commit terrorist acts, ignite interethnic, religious enmity, and the modern development of science and technology, the developed information field, make it possible to perform various kinds of actions within and outside the institutions in order to intimidate both convicts, the administration of the UIN, and the population. The manifestations of violence, cruelty, revenge, indicate that even those who are not related to the emergence of a conflict can become victims of such actions.

The experience of countering terrorism shows that there can be no reliable protection against such unlawful acts. It is indicated that only a joint, comprehensive set of nationwide measures of general and special prevention can minimize terrorist threats.

The proposed measures to minimize terrorist threats in places of detention. Among them are the following: overlapping of access channels of prohibited items, especially channels for the delivery of weapons, explosives, piercing-cutting objects; use of unspoken methods of work incl. agent network; providing technical equipment to personnel responsible for compliance with the regime and safety; the implementation of a set of other measures in penitentiary institutions, including the prevention of offenses and crimes.
