PRACTICAL REALIZATION OF THE INSTITUTE OF PERSONS, WHO COMMITTED CRIMINAL OFFENCES

Abstract

The paper analyzes the peculiarities of implementing the institute for the ex- tradition of persons who committed a criminal offense in law enforcement practice in international and national legislation.

Types of international cooperation in the field of ensuring the inevitability of criminal prosecution and punishment have been characterized, namely, the extradi- tion of persons who have committed crimes for bringing them to criminal responsi- bility and transfer to court in the state of which they are citizens.

It is clarified that at present the legislative recognition of the world society is recognized as a tendency to refuse issuance, if it is requested for the purpose of imposing on a person a criminal liability by an extraordinary court or in the form of a simplified procedure or for the purpose of executing a sentence rendered by such a court or in the form of a simplified procedure, when there are sufficient grounds for believing that in the course of such proceedings, the given person will not re- ceive or have not provided the minimum guarantees of the protection of human rights.

It is determined that it requires specific legislative changes and additions to Art. 10 of the Criminal Code of Ukraine, namely, it is proposed to make changes to Art. 10 of the Criminal Code of Ukraine "Resolution of the issue of criminal liability of persons who are subject to criminal responsibility under the laws of a foreign state and staying on the territory of Ukraine, and execution of sentences passed by foreign courts or international judicial institutions".
