HІSTORIC-LEGAL ANALYSIS OF COUNTERING OFFENCES RELATED TO THE INTELLECTUAL PROPERTY IN UKRAINE

It is determined that the state of combating the infringements in the sphere of intellectual property in our country does not meet the requirements of the modern society. Foreign experience shows that intellectual activity becomes more and more decisive driving force of any development. First of all, it defines the strategy and tactics of social and economic progress of any country. For many years, Ukraine has been one of the top ten countries in the world with the highest level of the intellectual property offenses. It is clear that this sphere has many problems to be resolved immediately. However, it is impossible to achieve this without the meaningful historical and legal analysis of counteraction to the offenses in the sphere of intellectual property in our country.
The historical aspect of the legal regulation of combating the infringements in the sphere of intellectual property has been analyzed. It has proved that there are a lot of laws, legal and normative acts, which contribute to counteract such offences and protect the rights of individuals in the sphere of intellectual property. A large number of such acts led to the need for their systematization, which would promote effective and qualitative counteraction to the offense, as well as justify the necessity and expediency of adopting a single legal act that would define the main principles of countering the infringements in the sphere of intellectual property in Ukraine.
It was clarified that the adoption of the Law of Ukraine "On Distribution of Copies of Audiovisual Works and Phonograms" aimed at protecting the interests of producers, distributors and users of such products was conditioned by the urgent need to protect the intellectual property rights of those objects. Therefore, Ukraine began to import actively the copies of audiovisual works and phonograms, which made the basis for committing delinquencies in the sphere of intellectual property, namely, falsification and "piracy".
