NORMATIVE-LEGAL REGULATION OF WASTE MANAGEMENT IN AGRICULTURE OF UKRAINE

Abstract

The article is devoted to the analysis of normative-legal regulation of waste management in agriculture from the time of Ukraine's independence to the present day. Formation and development of the legislation of Ukraine on waste management in agriculture has passed a number of stages, each of which has certain features. At the first stage, which is associated with the adoption of the Law of Ukraine "On Environmental Protection" (1991), the basic principles of waste management in agriculture were laid down. In the special agrarian legislation separate norms regulate questions of management of separate kinds of agricultural waste. The beginning of the second stage was marked by the adoption of the Law of Ukraine "On Waste" (1998). The main array of legislation is formed on the basis of unification of legal regulation. The third stage is related to the differentiation of legislation on agricultural waste and begins with the adoption of the Law of Ukraine "On animal by-products not intended for human consumption" (2015). A necessary condition for the development of legislation on agricultural waste is its adaptation to the requirements of EU legislation. In terms of content, the legal norms governing relations in the field of waste management in agriculture can be grouped into the following blocks of legal regulation: 1) norms that determine the general principles of waste management in agriculture; 2) norms that regulate the peculiarities of treatment of certain types of waste in agriculture; 3) norms that determine the legal status of subjects of waste management in agriculture; 4) нnorms that regulate certain operations with waste in agriculture (collection, processing, transportation, disposal, etc.); 5) norms in the field of institutional and functional support of waste management in agriculture; 6) norms that establish liability for violations of legislation on waste management in agriculture. According to the sectoral affiliation, the above legislation refers to environmental, land, agricultural, economic, administrative, international and other branches of law, which indicates the formation of a comprehensive legal institution of agricultural waste management in the agrarian law of Ukraine, which has an intersectoral nature.
