Abstract

Crimes committed by minors were and remain one of the most important social and legal problems in society. Minors are a particularly vulnerable layer of society. Daily they are subjected to outside influence, not always perceived correctly and often have wrong deeds, but because they require a special approach in the process of its formation and development as a person, especially after committing a minor offense.

The child remains a child even when doing poorly. She copies the behavior of adults, including criminals. Children comprise the age group of children in the period of psycho-physiological and social growth, which is characterized by role experimentation. Sometimes the lack of life experience, the failure to properly and adequately assess the situation, which turned out to be a teenager, he comes into conflict with the law. Therefore, we must not forget that the punitive impact on juvenile offenders, taking into account, of course, on the nature of the offense, must be very different than those that apply to adults.

The problem of creating a national model of probation is one of the most topical issues of modern Ukrainian science, in particular, law, pedagogics, social pedagogy, psychology. The absence in Ukraine of this standard, we can say that a typical element, without which it is impossible to imagine any modern national system of criminal justice, cannot cause the attention of scientists and practitioners. In modern societies the probation service remains extremely important to correctional Agency, the center of the criminal justice system. This is because punishment in form of imprisonment prevents further social adaptation of personality, her return to society, because people in penal institutions lose socially valuable skills. In addition, in prison, the offender usually takes criminal subculture, which does not contribute to resocialization of the individual.

We have to admit the lack of a unified legislative and theoretical approaches regarding the place and role of probation in the criminal, criminal-procedural and criminal-Executive legislation of Ukraine. Pressing is a rational and critical analysis of foreign experience, borrowing its positive achievements scientifically sound adaptation to modern conditions and requirements of the development of Ukrainian society. The study of international experience, both positive and negative, provides important information on possible ways of forming and reforming the probation service and its activities for the execution of punishments not connected with isolation from society to minors.

The article is devoted to investigation of some features of probation of working with minors with the aim of achieving correct them and prevent recurrence. Investigated the international experience of the probation work with juvenile offenders, and the possibility of its use in Ukraine.
