Current Problems of Pension Provision for Participants of Combat Operations in Ukraine

Abstract

The scientific article provides a comprehensive analysis of the current problems of legal and organizational provision of pension provision for combatants (UBD) in Ukraine under the conditions of Russian armed aggression. It is determined that today the pension provision of UBD is an extremely acute socio-legal problem that requires systematic improvement by the state. In particular, the following key problems are identified: structural and financial unpreparedness of the Pension Fund of Ukraine for the growth of the number of pensioners with a preferential status; low level of pension payments, which does not correspond to the contribution of veterans to the defense of the state; difficulty in obtaining additional payments and allowances; imperfection of legislative regulation and the practice of its application, including numerous cases of delays in recalculations and the need for judicial appeals of PFU decisions. Attention is drawn to the fact that despite the legally established guarantees, in particular the right to early retirement, pension supplements and other social benefits, their actual implementation is accompanied by excessive bureaucracy and instability of law enforcement.

It is substantiated that ensuring fair, decent and effective pension provision for UBD should become one of the key priorities of state policy in the field of social protection. The need for legislative clarification of the grounds and mechanisms for recognizing the status of a participant in hostilities is revealed, as well as the introduction of electronic services that will simplify the procedures for issuing pensions and accelerate access to appropriate financing. It is emphasized that the implementation of the above proposals will contribute to strengthening trust in the state, increasing the motivation of military personnel, as well as ensuring social justice for those who participated in the defense of the independence and territorial integrity of Ukraine.
