CONTENT OF THE ADMINISTRATIVE AND LEGAL BASIS OF THE TURNOVER AND USE OF FIRE-ARMS IN UKRAINE

Abstract

The article has proved that the content of the administrative and legal regu- lation of circulation and use of weapons in Ukraine is characterized by the adminis- trative principles (principles and concepts) and means of administrative legal rela- tions in that sphere (forms of administrative activities, methods of administrative activities, administrative procedures and administrative regime).

The administrative and legal support of the circulation and use of weapons in Ukraine has been characterized. It is aimed at identifying and creating adminis- trative grounds and tools for realizing administrative and legal relations in that sphere, as well as at protecting and guaranteeing the rights, liberties and legal in- terests of the subjects of those relations on the basis of legal norms At the same time, the grounds are the principles and concepts, under which the basic output, the guiding principles on which the activities of the public administration subjects in the sphere of circulation and use of weapons are based. Besides, the system of common views should be taken into account. There are such instruments: forms of administrative activity, methods of administrative activity, administrative proce- dures and administrative regimes.

It has been cleared up that in Ukraine the general legal basis for the use of weapons by officials, who are permitted to possess firearms in accordance with the current legislation, is the Regulations on the Procedure for the Use of Firearms, which was developed in 1992. It determined the procedure for the use of firearms by the military personnel of the Ministry of Defense, the Ministry of Internal Affairs, the State Security Service, the State Guard and Protection Service, the State Border Guard Committee, the National Intelligence Service, as well as the personnel of the State Committee for the Protection of the Special Communication Channels. by the relevant acts of the national legislation.

The content of the administrative and legal support for the circulation and use of weapons in Ukraine is characterized by the administrative principles (princi- ples and concepts). The tools for implementing administrative and legal relations in that sphere (forms of administrative activity, administrative methods, administra- tive procedures and administrative regimes), which are in an inextricable intercon- nection between each other, are described. It contributes to maximize their influ- ence on the above mentioned social relations.
