LEGAL REGULATION OF THE PRODUCTION OF ORGANIC CROP PRODUCTION IN UKRAINE AND GEORGIA

Abstract

The article clarifies the priority directions for the development of the agricultural sector of the economy of both Georgia and Ukraine. A comparative analysis of the legislation regarding the regulation of the production of organic plant products in Ukraine and Georgia was carried out. Recommendations regarding the implementation of norms from the Georgian legislation into the national legislation are provided, with the aim of improving the latter. The analyzed works of O.V. Gafurova, V.M. Yermolenko, T.V. Kurman, S.I. Marchenko, V.V. Melnyk, D.S. Piddubnoi, A.M. Stativky, V.Yu. Urkevycha, M.V. Shulga and other scientists who highlighted the legal issues of conducting organic agricultural production. The legislation of Georgia and Ukraine on organic agricultural production is similar, as the process of adaptation to the legislation of the European Union is ongoing. Thus, the legislation of these countries contains the main requirement for the operator, which consists in the certification of organic production, regulates the specifics of the use of plant protection products and fertilizers, methods of agricultural production, establishes the obligation to observe crop rotation, bans on the use of crops and drugs obtained by genetic engineering methods etc. In the legislation of Georgia and Ukraine, the development of organic agricultural production is declared a priority direction of the agrarian sector of the economy. In this part, the legislation of Georgia, in our opinion, is more progressive, since it not only declares priority, as in the legislation of Ukraine, but also adopts a special program for promoting bioproduction. At the same time, separate legal norms of the Law of Georgia "On Implementation of Biological Agricultural Production" can be implemented into the Law of Ukraine "On Basic Principles and Requirements for Organic Production, Circulation and Labeling of Organic Products", in particular in terms of organic farming, import of organic products, requirements for organic agricultural production. In addition, the experience of encouraging the transition to organic agricultural production is worth borrowing. This will contribute to the improvement of domestic legislation regarding the legal regulation of the production of organic crop production
