THE PROSECUTOR'S OFFICE OF UKRAINE AS A SUBJECT OF PREVENTION OF CRIMINAL OFFENSES IN THE SPHERE OF EXECUTION OF PUNISHMENTS AND PROBATION OF UKRAINE

Abstract

This scientific article analyzes the content of legal acts that regulate the activities of the prosecutor's office of Ukraine, and also clarifies its social and legal capabilities in preventing criminal offenses in the field of punishment and probation.

In particular, a number of legal conflicts have been identified that occur in the content of legislative and other normative legal sources, which relate to the implementation of prosecutorial supervision over the observance of laws in bodies and institutions for the execution of punishments in the execution of court decisions in criminal cases, as well as in the application of other coercive measures , related to the restriction of the personal freedom of citizens, which not only reduce the level of effectiveness of prosecutors on the specified issues, but also their potential opportunities in preventing criminal offenses in the sphere of execution of punishments and probation of Ukraine.

In addition, based on the results of the study, the necessity of harmonizing the content of sub-legal and departmental legal sources with the corresponding provision of those legislative acts that regulate the activities of prosecutor's offices as subjects of special criminological prevention of criminal offenses, including in the field of execution of punishments and probation, has been proven.

Again, taking into account the results of the study of the legal basis of the functioning of the prosecutor's office in this field of social relations, it was concluded that mainly prosecutorial supervision in the field of execution of punishments and probation is focused on the establishment of offenses committed against the rights of convicts, leaving them out of control the state of ensuring their legitimate interests and freedoms, which in the future becomes one of the subjects of consideration in the European Court of Human Rights, and therefore this aspect of the prosecutor's office should be taken into account when improving the legal mechanism for the prevention of criminal offenses.
