Main functions of social protection for judges in Ukraine

Abstract

The article aims to clarify the core functions of social protection for judges in Ukraine. Through an analysis of different scholarly perspectives on social protection functions, the author concludes that judges' social protection functions comprise general, basic, and optional functions. However, the main focus should be placed on the general and basic functions of social protection for judges. In performing its general functions, social protection ensures fair remuneration and financial security for judges. It contributes to their overall well-being and promotes a healthy work-life balance. Social protection also upholds political neutrality by safeguarding judges' social security, even when they handle cases involving political authorities. Furthermore, it addresses significant demographic concerns by addressing the social issues faced by judges and their families. Additionally, social protection ensures privacy within the system and facilitates the dissemination of information about the broader social, legal, institutional, and procedural aspects of the judges' social protection system. The implementation of the basic functions of social protection for judges enhances their well-being, security, and socio-economic stability. These functions recognize the unique social security needs of judges arising from their roles as judicial officers. They play a crucial role in optimizing judges' social protection system. While the general and basic functions should serve as the main guiding principles in optimizing the social protection system for judges, the article also acknowledges the importance of optional functions. These functions, which extend beyond the main functions, enhance the overall efficiency and adapt- ability of the social protection system for judges. The author highlights the need to consider these optional functions, particularly within the context of ongoing judicial and legal reform. In conclusion, the article summarizes the study's findings and emphasizes the significance of social protection's general and basic functions for judges. It underscores the importance of optimizing the social protection system for judges based on these functions. However, it also recognizes the value of incorporating optional functions to improve the system's overall effectiveness and adaptability.
