Legal status of the head of the National Police authority as a subject of law enforcement and discipline

Abstract

The article examines the administrative and legal status of the head of the National Police as a subject of legality and discipline. It is emphasized that the proper level of discipline among subordinates depends not only on the professionalism of the manager and his personal qualities, but also on his administrative and legal activities and the administrative and legal status of the National Police body itself. It is indicated that the understanding of the manager as a subject of legality and discipline was considered in the scientific literature as an element of a special legal status and did not have a separate study, that is, such a status of the manager was partially studied and mainly related to his punitive functions. Taking into account the gradual reformation of the police body and the understanding of the police as a body that provides certain services, it is impractical to examine the head in matters of ensuring legality and discipline in the body subordinate to him exclusively as a subject with punitive functions, and therefore an in-depth study of the administrative-legal status is relevant manager in the specified matter. It is emphasized that the administrative-legal status of the head of the police body as a subject of compliance with law and discipline should be supported by specific rights that such a head should use specifically to exercise leadership and management. And such powers must be clearly established, that is, they must have a certain form of expression - a rule of law established in a law or bylaw. In the context of this study, three components of the studied legal status of the manager are highlighted: 1) general legal status, which is inherent to all persons without exception and includes general rights and obligations; 2) special legal status, which has the following components: a) administrative and legal status of a police officer as an employee of the National Police; b) administrative and legal status of the head of the National Police body; 3) administrative and legal status of the police body itself.
