The role of judicial constitutional control: basic approaches to understanding

The article is devoted to the study of the essence and role of judicial constitutional control in the modern state. Particular attention is paid to the role of bodies of constitutional jurisdiction to ensure the rule of law and human rights.
It is concluded that the exchange of ideas between national constitutional courts regarding the understanding of the constitution and human rights is important for the exercise of constitutional jurisdiction.
Therefore, the purpose of this article is to analyze the main approaches to understanding the essence of constitutional control.
Constitutional control in the mechanism of state power in combination with general control is defined as an organizational and legal form of state activity, which has the following features: 1) it is a kind of institution of social, state control, which is carried out constantly current state bodies; it is directly related to the exercise of state powers; 2) it is a form of professional state control, and the highest among specialized forms of control activities; 3) constitutional control, being a controlling and law enforcement activity, is based on the predominance of the use of jurisdictional means; 4) constitutional control extends not only to the sphere of government, but also covers the sphere of rule-making, which is carried out by the administration, and affects the rule-making of the legislature; 5) the body of constitutional control is a specialized body for the protection of an act of higher legal force – the Constitution of the state; 6) constitutional control is the highest (after parliamentary and referendum) form of control
