LEGAL STATUS OF RECOVERY OF PROCEEDINGS IN THE STATE SECURITY BODIES OF THE USSR (1929-1953 YEARS): HISTORICAL AND LEGAL ANALYSIS

Abstract

The article describes the legal acts regulating the activity of places of detention of arrested in the organs of state security of the Ukrainian SSR during the totalitarian regime. In particular, it was approved during 1937–1944 by the orders of the NKVD and the NKGB of the USSR on the provisions of the internal prisons and adopted in their development and supplements other regulations that regulate the organization of the internal regime, external security, sanitary, food and property provision of the arrested and the investigators. It was found that since the mid-1930s, the main organizational forms of functioning of the places of those arrested in the state security organs were internal prisons and internal prison cameras.

During the investigated period there were changes in the subordination of these institutions. As part of the NKVD, they were subject to the Chief Prison Department and the prison departments and the NKVD-UNKVD branch, and after the establishment of the NKDB of the USSR – the 2nd departments of the NKDB-UNKDB, and subsequently the Division «A» of the NKDB of the USSR and its local authorities. Internal disposition and prison regime in places of detention were strict and violated the constitutional rights and freedoms of citizens.
