ABOUT SOME DETERMINANTS WHICH ARE PROTECTED FIGHT AGAINST THE MUTUAL NEIGHBORHOOD OF THE ADMINISTRATIVE ADMINISTRATION OF THE CORRECTED COLONIES

Abstract

The article analyzes the main determinants that promote and determine the implementation of malicious disobedience of the convicted administrations of correctional colonies, as well as developed scientifically grounded ways for their neutralization, blocking, elimination, etc.

As practice shows, crime of convicts is one of the major problems that affect the effectiveness of the execution process - serving sentences in Ukraine. At the same time, in the structure of crimes registered annually by these persons, almost 40% of the violent disobedience of the administration of penitentiary institutions (hereinafter – UVP) (Article 391 of the Criminal Code of Ukraine. Moreover, virtually all criminological indicators of this type of crime in correctional colonies, which are related to the requirements of Article 11 of the Criminal-Executive Code to the CIA (level, crime rate, geography, price, t. etc.) from year to year are also unchanged.

All this is the result of the stereotypical and inadequate actions of the administration of correctional colonies and other actors in the prevention of crimes in the field of the execution of sentences in preventing and responding generally to this socially dangerous phenomenon. Particular attention in this context deserves the activity of the indicated subjects for neutralization, blocking, elimination, etc., determinants that promote and determine the commission of malicious disobedience of convicts, which today is not sufficiently effective and unsystematic, and ultimately leads to the unchanging situation , formed in the fight against this type of crime in the PIs.

Thus, it is worth noting that there is a complex application problem that needs to be addressed at all levels (legislative, organizational and managerial, logistical, etc.), including scientific ones.

The above circumstances predetermined the choice of the topic of this scientific article, as well as determined its main task - based on the results of the analysis of the main determinants that promote and cause malicious disobedience to the administration of the correctional colonies, to develop scientifically grounded measures to improve preventive activities on the identified issues of research.
