Legal support of the state economic policy in modern conditions

Abstract

The article analyzes the current state of legal regulation of the State's economic policy and possible prospects for solving the main problematic issues in this area. The author emphasizes the importance of reformatting the current economic policy of the State with due regard for the realities of today.

The article analyzes the positions of scholars on the definition of the concept of economic policy of the State, its relationship with economic and legal policy, and identifies the main problems associated with the regulation of economic relations under the martial law regime, in particular, the lack of adequate legal support for the exercise of functions by economic entities, as well as the lack of forecasting analysis and models of economic development of the State.

The author identifies the main legal acts regulating the issues of determining the main directions and implementation of the State's economic policy. The author emphasizes the need to amend a number of legislative acts in connection with the abolition of the Economic Code of Ukraine. The author also identifies the main challenges and obstacles to the development of the national economic system of Ukraine.

The author emphasizes that governmental measures aimed at influencing and adjusting the content, direction and dynamics of the evolution of public relations should include a mandatory preparatory stage within the framework of the functioning of the State mechanism. In general, it is argued that such a preparatory stage should include an analysis of the current state and trends in the development of social relations, political and legal assessment of social relations, forecasting the consequences of the development of social relations, and formation of an optimal development model, analysis of the resource and instrumental capabilities of the State, formalization of political doctrines in legal acts, and monitoring and adjustment of public policy. The author emphasizes the need to create a concept and strategy, a certain vision of the process of economic recovery in the post-war period, in order to develop measures of legal influence on these relations at the legislative level.
